Information on the processing of personal data

Information on the processing of personal data of job applicants on the protection of personal data and on amendments and supplements to certain acts (hereinafter referred to as the "Act") and Articles 13 and 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the "Regulation")

The aim of this information is to provide you with information about what personal data we process, how we handle it, for what purposes we use it, to whom we may provide it, where you can obtain information about your personal data and exercise your rights when processing personal data.

1. Purpose of processing personal data, legal basis for processing and retention period

Purpose of processing personal data is the inclusion of an applicant in the register of applicants for employment for the purpose of assessing suitability for a given job position within the meaning of §13 para. 1 letter b) of the Act, Art. 6 para. 1 letter b) of the Regulation and Art. 11 of the Labor Code. The controller processes personal data for the period necessary to assess the candidate's suitability for a given job position.

In the event of voluntary consent of the data subject pursuant to §13(1)(a) of the Act and Art. 6(1)(a) of the Regulation, the operator keeps the job applicant in the register of job applicants for a longer period of time, for the purpose of participation in future selection procedures, in accordance with the consent granted.

Legitimate interests of the controller or a third party
Personal data is not processed for the purposes of the legitimate interests of the controller or a third party.

2. Identification of the processed personal data of the data subjectss

Osobné údaje uchádzačov o zamestnanie v rozsahu žiadosti o zamestnanie, životopisu, dokladov a potvrdení týkajúcich sa vzdelania, či kvalifikácie uchádzača o zamestnanie, prípadne v iných poskytnutých materiáloch súvisiacich so žiadosťou o zamestnanie.

3. Identification of beneficiaries, categories of beneficiaries 

Prevádzkovateľ môže poskytnúť osobné údaje:
Authorized entities (institutions/organizations) under a specific legal regulation, e.g.
        health insurance companies
        social insurance company
        tax administrator
        Headquarters of Labor, Social Affairs and Family
        supplementary pension savings banks
        pension management companies
        state administration and public authorities for the exercise of control and supervision (e.g. labor inspectorate)
        court, authorities involved in criminal proceedings
        bailiff or other authorized entity

4. Transfer of personal data to a third country/international organization

Transfer to third countries or international organizations is not carried out.

5. Identification of the source from which the personal data was obtained

Directly from the data subject or their legal representative.

6. Profiling

The operator does not process personal data through profiling or in a similar manner based on automated individual decision-making.

7. Rights of the data subject

The data subject has the right to request from the controller access to personal data processed about him or her, the right to rectification of personal data, the right to erasure or restriction of processing of personal data, the right to object to processing of personal data, the right to the ineffectiveness of automated individual decision-making, including profiling, the right to data portability, as well as the right to file a complaint with a supervisory authority. If the controller processes personal data based on the consent of the data subject, the data subject has the right to withdraw his or her consent to the processing of personal data at any time. The withdrawal of consent does not affect the lawfulness of the processing of personal data based on consent before its withdrawal. The data subject may exercise his or her rights by sending an email to the address: jaffa@jaffa.sk, or in writing to the address of the controller.

8. Obligation to provide personal data

The provision of personal data in the case of processing personal data based on consent for the purpose of managing the job applicant for the purpose of participating in future selection procedures of the data subject is voluntary; if consent is not provided, the controller will not process personal data for longer than is necessary to assess the job applicant's suitability for the given job position.
The provision of personal data processed under the Labor Code and special laws is a legal requirement / contractual requirement, or a requirement that is necessary for the conclusion of a contract. The data subject is obliged to provide personal data; if they are not provided, the controller will not ensure the conclusion or performance of the contract.
